1. Our Service
Brainytots creates personalized songs from the stories and details you share with us. Songs, lyrics, and musical arrangements are produced using automated music-production technology; we do not employ or commission human songwriters, lyricists, vocalists, or music producers. You review the full lyrics and approve every line before your song is produced.
2. Account Registration
When you create an account with us, you must provide accurate, complete, and up-to-date information. You are responsible for safeguarding your password and for any activities that occur under your account.
3. Our Services
Brainytots provides personalized song creation services based on information you provide. By submitting content for your personalized song, you grant us the right to use, modify, and incorporate that content into your song.
4. Payment and Billing
Prices for our services are listed on our website and are subject to change. Payment is required at the time of order placement. We accept various payment methods as indicated during checkout.
5. Delivery and Turnaround Time
Standard orders are delivered within 48 hours of order placement, subject to your timely review and approval of the lyrics. Express orders are delivered within 6 hours of order placement under the same condition. Delays caused by pending lyrics approval extend the delivery window accordingly.
6. Revisions, Approval, and Refunds
You approve every line of the lyrics before production. Each package includes the number of revisions indicated at the time of purchase (Quick: 2, Premium: 3, Ultimate: unlimited). If you are not satisfied with your delivered song, you may request a full refund within 24 hours of delivery, subject to the fair-use limits set out in our Refund Policy.
7. Intellectual Property Rights
Upon full payment, you receive a non-exclusive license to use the song for personal, non-commercial purposes. Brainytots retains ownership of all intellectual property rights to the song, including copyright to the music, melody, and arrangement.
You may not:
- Use the song for commercial purposes without obtaining an additional license
- Sell, redistribute, or publicly perform the song
- Claim ownership or authorship of the song
8. User Content
When you provide us with information for creating your song, you represent that you have the right to share this information and that it does not violate any third-party rights or laws.
9. Limitation of Liability
Brainytots shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.
10. Governing Law
These Terms shall be governed by the laws of India without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this page.
